Sense ella, no pots operar legalment, no et pots anunciar a Airbnb ni Booking, i t&#8217;exposes a sancions que poden superar els 90.000 \u20ac.<br>Tot all\u00f2 referent a la legalitat i requisits per a lloguer tur\u00edstic d&#8217;una casa rural a Catalunya est\u00e0 definit al <strong>Decret 75\/2020<\/strong> de <strong>Turisme de Catalunya<\/strong>, secci\u00f3 IV.<br>En aquest article us expliquem quins tipus de llic\u00e8ncia existeixen, quins requisits has de complir, com \u00e9s el proc\u00e9s pas a pas i qu\u00e8 ha canviat amb la normativa m\u00e9s recent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Llic\u00e8ncia tur\u00edstica rural vs. Habitatge d&#8217;\u00fas tur\u00edstic (HUT): quina \u00e9s la difer\u00e8ncia?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c9s el primer punt que genera m\u00e9s confusi\u00f3, i \u00e9s important aclarir-ho des del principi, perqu\u00e8 no s\u00f3n el mateix i el procediment varia.<br><strong>Habitatge d&#8217;\u00das Tur\u00edstic (VUT o HUT)<\/strong> \u00e9s la modalitat per a habitatges que es lloguen complets per a estades curtes de fins a 31 dies. Poden estar a s\u00f2l urb\u00e0 o r\u00fastic, sempre que disposin de c\u00e8dula d&#8217;habitabilitat. No es permet el lloguer per habitacions.<br><strong>Establiments de Turisme Rural<\/strong> \u00e9s la categoria espec\u00edfica per a propietats ubicades a entorns rurals amb vocaci\u00f3 d&#8217;oferir una experi\u00e8ncia lligada al territori.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Han de situar-se al medi rural:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A\u00efllades o b\u00e9 a municipis de menys de 2.000 habitants.<\/li>\n\n\n\n<li>Edificacions preexistents al 1957.<\/li>\n\n\n\n<li>Respectar la tipologia arquitect\u00f2nica de la zona.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Inclou quatre modalitats:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Allotjaments rurals<\/strong>:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><\/td><td class=\"has-text-align-center\" data-align=\"center\"><br>A\u00efllades<\/td><td class=\"has-text-align-center\" data-align=\"center\"><br>Dintre del nucli municipi<\/td><\/tr><tr><td><br>Titular conviu amb els hostes, cedeis habitacions i ofereix esmorzar<\/td><td class=\"has-text-align-center\" data-align=\"center\"><br><strong>Masia<\/strong><\/td><td class=\"has-text-align-center\" data-align=\"center\"><br><strong>Casa de poble compartida<\/strong><\/td><\/tr><tr><td><br>Casa sencera, cessi\u00f3 complerta<\/td><td class=\"has-text-align-center\" data-align=\"center\"><br><strong>Masoveria<\/strong><\/td><td class=\"has-text-align-center\" data-align=\"center\"><br><strong>Casa de poble independent<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cases de pag\u00e8s:<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00f3n les mateixes modalitats que les anteriors, per\u00f2 en aquest cas el propietari desenvolupa una <strong>activitat agr\u00edcola<\/strong>, <strong>ramadera<\/strong> o <strong>forestal<\/strong> i els hostes tenen la possibilitat de con\u00e8ixer aquestes activitats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En tots els casos, la <strong>capacitat m\u00e0xima<\/strong> no pot superar les 20 persones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si la vostra propietat \u00e9s una masia o casa rural t\u00edpica, el m\u00e9s habitual \u00e9s que encaixi en la modalitat d&#8217;<strong>Establiment de Turisme Rural<\/strong>, que a m\u00e9s us permet diferenciar-vos d&#8217;un simple pis tur\u00edstic i transmetre m\u00e9s valor de marca.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Marc legal vigent: quina normativa aplica<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La regulaci\u00f3 dels allotjaments tur\u00edstics a Catalunya est\u00e0 recollida principalment al Decret 75\/2020 de Turisme de Catalunya, que \u00e9s el marc general per a tot tipus d&#8217;allotjament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No obstant aix\u00f2, hi ha una norma que ha canviat significativament el panorama per a les noves llic\u00e8ncies: el <strong>Decret llei 3\/2023<\/strong>, aprovat el novembre de 2023. Aquesta norma exigeix \u200b\u200buna llic\u00e8ncia urban\u00edstica pr\u00e8via per a la majoria de nous habitatges d&#8217;\u00fas tur\u00edstic als 262 municipis catalans considerats d&#8217;alta pressi\u00f3 d&#8217;habitatge, i estableix un l\u00edmit m\u00e0xim de 10 habitatges tur\u00edstics.<br>Un punt clau: aquesta restricci\u00f3 afecta principalment les VUT (pisos tur\u00edstics), <strong>no<\/strong> als <strong>Establiments de Turisme Rural<\/strong>, que segueixen un procediment diferent. Si la vostra propietat \u00e9s una casa rural o masia en entorn rural, \u00e9s possible que quedeu fora de les restriccions m\u00e9s dures del Decret llei 3\/2023. Tot i aix\u00ed, sempre \u00e9s recomanable verificar-ho amb el teu ajuntament abans d&#8217;iniciar qualsevol tr\u00e0mit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Esmentar que el NRUA (Nombre de Registre \u00danic d&#8217;Arrendament) no \u00e9s necessari per a establiments rurals i a m\u00e9s una sent\u00e8ncia del Tribunal Suprem de Maig 2026 ha declarat nul aquest requisit per a qualsevol establiment per la duplicitat que genera amb les comunitats aut\u00f2nomes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Requisits que ha de complir la teva propietat<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Independentment de la modalitat, la teva casa rural ha de complir una s\u00e8rie de requisits m\u00ednims abans de poder sol\u00b7licitar la llic\u00e8ncia:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>C\u00e8dula d&#8217;habitabilitat<\/strong> <strong>en vigor<\/strong>: \u00e9s el document m\u00e9s important i sense aquest no es pot tramitar res. Si heu caducat o la vostra propietat mai l&#8217;heu tinguda, l&#8217;haureu d&#8217;obtenir abans d&#8217;iniciar el proc\u00e9s.<\/li>\n\n\n\n<li><strong>Habitatge moblat i equipat<\/strong>: la propietat ha d&#8217;estar a punt per rebre hostes amb el mobiliari i equipament b\u00e0sic.<\/li>\n\n\n\n<li><strong>Serveis b\u00e0sics<\/strong>: electricitat, aigua calenta i calefacci\u00f3 s\u00f3n obligatoris.<\/li>\n\n\n\n<li><strong>Asseguran\u00e7a de responsabilitat civil<\/strong>: obligat\u00f2ria per cobrir possibles danys a tercers durant les estades.<\/li>\n\n\n\n<li><strong>Tel\u00e8fon d&#8217;atenci\u00f3 a l&#8217;hoste operatiu 24 hores<\/strong>: cal que hi hagi un contacte disponible per a incid\u00e8ncies en tot moment.<\/li>\n\n\n\n<li><strong>Fulls de reclamacions<\/strong> i <strong>cartell informatiu <\/strong>visible a l&#8217;habitatge.<\/li>\n\n\n\n<li><strong>Compatibilitat urban\u00edstica<\/strong>: la propietat ha de complir el planejament municipal. Aquest punt pot ser complex a s\u00f2l no urbanitzable o a cases amb situacions urban\u00edstiques irregulars.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">El proc\u00e9s pas a pas<\/h2>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 1: Consulta pr\u00e8via a l&#8217;ajuntament<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Abans de preparar cap document, consulteu a l&#8217;ajuntament del vostre municipi si l&#8217;activitat tur\u00edstica \u00e9s compatible amb l&#8217;\u00fas del s\u00f2l on s&#8217;ubica la vostra propietat i si hi ha restriccions en vigor. Cada municipi t\u00e9 la seva normativa local, i les respostes poden variar molt d&#8217;un poble a un altre.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 2: Obtenir o renovar la c\u00e8dula d&#8217;habitabilitat<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Si no teniu c\u00e8dula d&#8217;habitabilitat en vigor, aquest \u00e9s el vostre primer tr\u00e0mit. Es demana a trav\u00e9s del departament d&#8217;habitatge de la Generalitat i requereix la visita d&#8217;un t\u00e8cnic habilitat que certifiqui que l&#8217;habitatge compleix les condicions m\u00ednimes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 3: Preparar la documentaci\u00f3<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La documentaci\u00f3 habitual per a un Establiment de Turisme Rural a Catalunya inclou:<\/li>\n\n\n\n<li>C\u00e8dula d&#8217;habitabilitat en vigor<\/li>\n\n\n\n<li>DNI o NIF del titular<\/li>\n\n\n\n<li>Escriptura de propietat o t\u00edtol habilitant<\/li>\n\n\n\n<li>Pl\u00e0nol de situaci\u00f3 i pl\u00e0nol de l&#8217;habitatge<\/li>\n\n\n\n<li>Asseguran\u00e7a de responsabilitat civil<\/li>\n\n\n\n<li>Descripci\u00f3 de la capacitat m\u00e0xima d&#8217;allotjament<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 4: Comunicaci\u00f3 al Registre de Turisme de Catalunya<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">El procediment central \u00e9s la presentaci\u00f3 d\u201funa Declaraci\u00f3 Responsable davant el Registre de Turisme de Catalunya (RTC), a trav\u00e9s del <strong>Canal Empresa de la Generalitat<\/strong>. Aquesta declaraci\u00f3 comporta la inscripci\u00f3 autom\u00e0tica al registre i l&#8217;<strong>obtenci\u00f3 del NIRTC<\/strong> (Nombre d&#8217;Inscripci\u00f3 al Registre de Turisme de Catalunya), que s&#8217;ha de mostrar a l&#8217;habitatge i a tota la publicitat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El tr\u00e0mit es pot iniciar en l\u00ednia a trav\u00e9s de <a href=\"https:\/\/tramits.gencat.cat\/ca\/tramits\/\" type=\"link\" id=\"https:\/\/tramits.gencat.cat\/ca\/tramits\/\">tramits.gencat.cat<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 5: Comunicaci\u00f3 a l&#8217;ajuntament<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A m\u00e9s del tr\u00e0mit amb la Generalitat, heu de comunicar l&#8217;inici d&#8217;activitat a l&#8217;ajuntament on s&#8217;ubica la propietat. Alguns ajuntaments exigeixen documentaci\u00f3 addicional o tenen procediments propis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pas 6: Registre de viatgers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A Catalunya, el registre de les dades dels hostes no es fa a trav\u00e9s del sistema estatal SES. Hospedajes, sin\u00f3 a trav\u00e9s dels Mossos d&#8217;Esquadra, mitjan\u00e7ant el sistema propi de la Generalitat. Heu de comunicar les dades de cada hoste en el termini establert.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Obligacions una vegada obtinguda la llic\u00e8ncia<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tenir la llic\u00e8ncia no \u00e9s el final del proc\u00e9s: comporta una s\u00e8rie d&#8217;obligacions continuades:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Exhibiu el NIRTC en un lloc visible de l&#8217;habitatge i en tots els anuncis publicitaris.<\/li>\n\n\n\n<li>Disposar de fulls de reclamacions dins de lhabitatge.<\/li>\n\n\n\n<li>Recaptar i liquidar l&#8217;impost sobre les estades en establiments tur\u00edstics (IEET), conegut com a \u00abtaxa tur\u00edstica\u00bb, que a Catalunya s&#8217;aplica a totes les pernoctacions en allotjaments tur\u00edstics.<\/li>\n\n\n\n<li>Registrar les dades dels hostes mitjan\u00e7ant el sistema dels Mossos d&#8217;Esquadra.<\/li>\n\n\n\n<li>Mantenir la c\u00e8dula d&#8217;habitabilitat vigent i l&#8217;asseguran\u00e7a de responsabilitat civil activa.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 passa si opero sense llic\u00e8ncia?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Les conseq\u00fc\u00e8ncies de llogar sense llic\u00e8ncia a Catalunya s\u00f3n greus. La Generalitat pot imposar sancions fins a 90.000 euros per infraccions molt greus. A m\u00e9s, Airbnb i Booking estan obligades des del 2025 a verificar el n\u00famero de registre i a retirar els anuncis que no ho acreditin. El tancament de l&#8217;activitat per ordre administrativa \u00e9s tamb\u00e9 una possibilitat real.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En un context en qu\u00e8 la inspecci\u00f3 s&#8217;ha endurit significativament, operar sense llic\u00e8ncia \u00e9s un risc que no val la pena assumir-ho i que no recomanem en cap cas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Un proc\u00e9s complex que es pot simplificar<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La tramitaci\u00f3 d\u201funa llic\u00e8ncia tur\u00edstica rural a Catalunya no \u00e9s especialment complicada si la propietat compleix els requisits i el municipi no t\u00e9 restriccions addicionals.
